TERMS OF SERVICE

PLEASE READ CAREFULLY.

THESE TERMS CONTAIN A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER. IT AFFECTS YOUR LEGAL RIGHTS.

1. INTRODUCTION AND ACCEPTANCE

Welcome to Dinks & Drinks Pickleball Club (“Dinks & Drinks,” “Company,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of:

• The Dinks & Drinks mobile application (the “App”)

• Our website

• League participation

• Events and related services

By using the App, registering for a league, or participating in any event, you agree that:

• You are at least 18 years old

• You have read and understand these Terms

• You agree to be legally bound by them

If you do not agree, you may not use our services.

We may update these Terms at any time. Continued use after updates constitutes acceptance of the revised Terms.

2. DESCRIPTION OF SERVICES

Dinks & Drinks provides:

• League and tournament management

• Event scheduling and RSVP tools

• Messaging and communication features

• Score tracking and leaderboards

• Member profiles and directory

• Social and optional matching features

• Merchandise and club store access

Services may change or evolve at any time.

3. USER ACCOUNTS

To use the App, you must create an account with accurate information.

You are responsible for:

• Maintaining login confidentiality

• All activity under your account

• Notifying us of unauthorized use

We may suspend or terminate accounts for:

• Violation of these Terms

• Harassment or abusive behavior

• Fraud or illegal activity

• Repeated no-shows or rule violations

• Non-payment

4. MEMBERSHIP, LEAGUE REGISTRATION & FEES

A. Separate League Registration

Each league season requires a separate registration and full payment.

Your spot is confirmed only after payment is successfully processed.

League fees cover:

• Court reservations

• Equipment and scheduling

• League administration

• App and score tracking systems

B. Refund Policy

We aim to be fair while protecting pre-paid court costs.

• Full refunds are available up to 48 hours before the official league start date.

• Once the league season has officially started, league fees are non-refundable.

• Missed weeks are not eligible for refunds, credits, or transfers.

• No-shows are not eligible for make-up sessions or refunds.

In limited cases involving documented medical emergencies or relocation, partial credit may be considered at the sole discretion of Dinks & Drinks.

This policy allows us to reserve courts and maintain a stable league experience for all players.

C. Payment Processing

Payments are processed through third-party providers (e.g., Stripe). By submitting payment, you authorize us and our payment processors to charge your payment method.

All fees are in U.S. Dollars.

5. ATTENDANCE & RSVP POLICY

To ensure fair court access and proper planning:

• Players must RSVP for each match day at least 2 hours before scheduled start time.

• Court space cannot be guaranteed without timely RSVP.

• Late arrivals may be rotated in based on availability.

Repeated failure to RSVP or repeated no-shows may result in removal from the league without refund.

This policy ensures proper court management and fair playing time.

6. LEAGUE APP & SCORE TRACKING REQUIREMENTS

Participation in league play requires:

• Installation and use of the official Dinks & Drinks App (iOS or Android).

• Entering or confirming match scores in the App during or immediately after play.

• Monitoring league updates and schedule changes through the App.

The App is an essential component of league operations. Failure to use required features may result in removal from the league.

7. CODE OF CONDUCT

We are building a respectful, social, competitive environment.

You agree to:

• Treat players, staff, and facilities respectfully

• Follow league rules and scheduling policies

• Communicate professionally

You agree NOT to:

• Harass or threaten others

• Post discriminatory or inappropriate content

• Disrupt events

• Create fake accounts

• Use the App for illegal purposes

We reserve the right to remove any participant who violates these standards.

If a player is removed for rule violations or misconduct, fees are non-refundable.

8. EVENTS & LIABILITY WAIVER

By participating in leagues, tournaments, or events, you acknowledge:

• Pickleball involves physical activity and risk of injury.

• You participate voluntarily and at your own risk.

• You are physically capable of participation.

• You assume full responsibility for your health and safety.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND WAIVE ANY CLAIMS AGAINST DINKS & DRINKS LLC, ITS OWNERS, OFFICERS, STAFF, AND VOLUNTEERS FOR INJURIES, DAMAGES, OR LOSSES ARISING FROM PARTICIPATION IN CLUB ACTIVITIES.

9. SOCIAL / MATCHING FEATURES

Participation in any optional social or matching features is voluntary.

We are not responsible for:

• Offline interactions

• Personal relationships

• Outcomes of matches

• Safety outside official events

Members are solely responsible for their conduct and personal safety.

10. DISCLAIMERS

Services are provided “AS IS” and “AS AVAILABLE.”

We do not guarantee:

• Uninterrupted service

• Match compatibility

• Accuracy of user-provided information

• Availability of specific courts or matchups

11. LIMITATION OF LIABILITY

To the maximum extent permitted by law:

Dinks & Drinks LLC shall not be liable for indirect, incidental, special, or consequential damages.

Our total liability shall not exceed the greater of:

• Fees paid by you in the previous three months, or

• $100.

12. INDEMNIFICATION

You agree to indemnify and hold harmless Dinks & Drinks LLC and its affiliates from claims arising out of:

• Your participation

• Your violation of these Terms

• Your misconduct

13. DISPUTE RESOLUTION & ARBITRATION

Before filing a legal claim, you agree to attempt informal resolution by contacting:

support@dinksanddrinksclub.com

If unresolved, disputes will be resolved through binding arbitration in Los Angeles, California under American Arbitration Association rules.

YOU WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

Small claims court matters under $10,000 are excluded.

14. GOVERNING LAW

These Terms are governed by the laws of the State of California.

15. GENERAL PROVISIONS

If any provision is found invalid, the remainder remains enforceable.

These Terms constitute the entire agreement between you and Dinks & Drinks.
